for the online store of Steffen Freiling Photography

Section 1 Scope

(1) These General Terms and Conditions (GTC) apply to all orders placed by consumers or businesses via the online store of Steffen Freiling (hereinafter referred to as “Seller”).

(2) A consumer is any natural person who concludes a legal transaction for purposes that cannot be attributed primarily to their commercial or independent professional activity (Section 13 BGB).

(3) An entrepreneur is a natural or legal person or a partnership with legal capacity that is acting in the exercise of its commercial or independent professional activity when concluding the legal transaction (§ 14 BGB).

Section 2 Contracting parties, conclusion of contract

(2) By placing the products in the online store, the seller makes a binding offer to conclude a contract for these items.

(3) The customer can initially place the products in the shopping cart without obligation and correct his entries at any time before sending the binding order.

(4) The contract is concluded when the customer accepts the offer for the goods contained in the shopping cart by clicking on the order button.

Section 3 Prices, shipping costs, payment methods

(1) The tax rates applicable to the country of delivery are displayed in the shopping cart and at the checkout.

(2) For deliveries to countries outside the EU, additional customs duties, taxes and fees are payable by the buyer.

(3) In addition to the stated prices, shipping costs will be charged. The amount of the shipping costs is shown in the order process.

(4) The following payment methods are available: Credit card, PayPal, Apple Pay, Google Pay, Klarna Pay Now (Sofort) / Instant bank transfer (Klarna), prepayment/bank transfer.

(5) The provider reserves the right to exclude certain payment methods in individual cases.

Section 4 Delivery, delivery times and shipping conditions

(1) Delivery times

Innerhalb Deutschlands beträgt die Lieferzeit ca. 2 Wochen, gerechnet ab Zahlungseingang. Innerhalb der Europäischen Union beträgt die Lieferzeit ca. 2–3 Wochen, gerechnet ab Zahlungseingang. Weltweite Lieferungen erfolgen in der Regel innerhalb von 3–5 Wochen, abhängig vom Bestimmungsland und den jeweiligen Transportbedingungen. Sollte ein Werk nicht in diesen Zeiträumen lieferbar sein, wird der Anbieter den Kunden unverzüglich informieren.

(2) Shipping conditions

The goods are shipped as an insured parcel via established shipping service providers (e.g. DHL, UPS, FedEx or comparable providers). The goods are packed carefully and securely for transportation. The provider bears the transportation risk. If the goods are lost or damaged in transit, the customer will receive a replacement or refund free of charge. The customer is obliged to complain about externally visible transport damage immediately to the deliverer and to inform the provider immediately.

(3) Customs duties, taxes and fees for international shipments

For deliveries to countries outside the European Union, additional customs duties, taxes or fees may be incurred, which are to be borne by the customer. These costs are not included in the shipping costs of the provider and are to be paid by the customer directly to the responsible authorities or customs offices. The provider has no influence on the amount of these charges. The customer can obtain information about any costs from the local customs authorities before ordering.

Section 5 Right of withdrawal

(1) Consumers have a statutory right of withdrawal. The details are set out in the cancellation policy which is an integral part of these GTC.

(2) The right of withdrawal does not apply to goods that are manufactured according to customer specifications (e.g. individually selected formats, frames or custom-made products).

(3) If the customer exercises his right of withdrawal, he shall bear the direct costs of the return shipment.

Section 6 Retention of title

The goods remain the property of the seller until full payment has been made.

Section 7 Warranty, guarantee

(1) The statutory warranty rights shall apply.

(2) An additional guarantee only exists if this is expressly stated in the product description.

Section 8 Copyrights

(1) All works offered in the store are protected by copyright.

(2) With the purchase of a work of art, the customer only acquires ownership of the physical work, but not rights of use or exploitation.

(3) Any duplication, digital distribution or public reproduction is prohibited unless otherwise agreed in writing.

Section 9 Dispute resolution

(1) The European Commission provides a platform for online dispute resolution (OS): https://ec.europa.eu/consumers/odr.

(2) The provider is not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.

Section 10 Place of jurisdiction and applicable law

(1) The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

(2) For consumers with their habitual residence in the EU, the mandatory consumer protection provisions of their country of residence also apply.

(3) If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is the registered office of the provider.
